These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Job Crackle, an Indian company ("Company," "we," "us," or "our") governing your access to and use of the Job Crackle platform, including our website, mobile applications, desktop applications (Electron app), and all related services (collectively, the "Service").

Since Job Crackle is an Indian company operating primarily from India, these Terms are governed by Indian laws and regulations. BY ACCESSING OR USING OUR SERVICE, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS, WHETHER OR NOT YOU REGISTER FOR AN ACCOUNT. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST DISCONTINUE USE IMMEDIATELY.

2. Definitions

"AI Services" means our artificial intelligence-powered resume optimization, job matching, and related features.

"Content" means all text, data, information, software, graphics, or other materials.

"Job Data" means employment opportunities, job postings, and related information aggregated from various sources.

"Personal Data" means any information relating to an identified or identifiable natural person.

"Subscription" means paid access to premium features including Pro and Ultra plans.

"User Content" means all content you submit, upload, or provide to our Service.

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least 18 years old to use our Service. If you are under 18, you may only use our Service with the involvement and consent of a parent or guardian.

3.2 Account Registration

To access certain features, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3 Account Security

You must immediately notify us of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to comply with this security obligation.

4. Service Description

4.1 Core Services

Job Crackle provides the following services to help you with your career:

  • AI-Powered Resume Optimization: We use third-party AI services (OpenAI GPT models, Google Gemini, Claude, and NVIDIA APIs) to help improve your resume content and format
  • LaTeX Resume Conversion: Convert your resume to professional LaTeX format for better ATS (Applicant Tracking System) compatibility
  • Job Search and Aggregation: We collect job postings from multiple sources including LinkedIn, Indeed, Monster, Greenhouse, Lever, and 20+ other job boards
  • Real-time Job Alerts: Get notified when new jobs matching your preferences are posted
  • Resume Analysis: AI-powered analysis to optimize your resume for specific job descriptions
  • Career Guidance: Personalized job matching and career recommendations

Important Information About Our AI Services:

  • • We use third-party AI providers (OpenAI, Google, Anthropic, NVIDIA) to process your resume content
  • We do NOT train our own AI models - we only use existing AI services through their APIs
  • • Your resume data may be sent to these AI providers for processing, subject to their privacy policies
  • • We do not store or retain copies of your data with these AI providers beyond the processing session
  • • AI-generated suggestions are automated and may not always be accurate - please review all changes

Important Information About Job Data Sourcing:

  • • We aggregate job postings from various job platforms and sources for better user visibility
  • We do NOT own any logos, content, or intellectual property from these job platforms - they are the sole owners
  • • We only process and enrich job data to improve user experience and job matching
  • • We respect and maintain the rights of all job platform owners and content creators
  • • Job listings displayed on our platform may originate from third-party sources, including but not limited to LinkedIn, Indeed, and other publicly accessible job boards. We display only limited portions of such content and direct users to the original source for the full listing and application process. We comply with the respective platform's terms of service and promptly remove any content upon request. We neither claim ownership of nor provide any warranties for third-party content.

4.2 Subscription Plans

Free Trial: Limited access with 10 AI resume optimizations and 3 LaTeX conversions

Pro Plan: 500 monthly requests, 100 LaTeX conversions, faster AI response times

Ultra Plan: 1000 monthly requests, 200 LaTeX conversions, live job alerts, priority support

4.3 Data Storage and Infrastructure

Database and Storage:

  • Primary Database: MongoDB Atlas (cloud-hosted MongoDB database)
  • File Storage: Supabase for secure file storage and management
  • Application Hosting: Vercel for web application deployment
  • Data Location: Your data is primarily stored in secure cloud servers

Third-Party Services We Use:

  • AI Processing: OpenAI, Google Gemini, Claude (Anthropic), NVIDIA APIs
  • Authentication: Google OAuth for secure login
  • Payment Processing: Dodo Payments for subscription billing
  • Job Data Sources: LinkedIn, Indeed, Monster, Greenhouse, Lever, and other job boards

4.4 Third-Party Service Disclaimer

Important: Use of AI features may be subject to additional terms of third-party providers (OpenAI, Google, Anthropic, NVIDIA). We are not responsible for any errors, outages, policy changes, or actions/omissions of these third-party providers. Users are also bound by the terms of service of these third-party providers.

4.5 International Use and Export Controls

You may not use the Service in violation of applicable export control laws or in jurisdictions where such use is restricted. You are solely responsible for compliance with local laws in your jurisdiction. If you are accessing the Service from outside India, you are responsible for compliance with local laws. Use of the Service does not subject Job Crackle to the laws or jurisdiction of any country other than India.

4.6 Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We reserve the right to modify, suspend, or discontinue any part of our Service with or without notice. As an Indian company, our primary support hours are during Indian Standard Time (IST).

5. Payment Terms and Billing

5.1 Subscription Fees

Subscription fees are charged in advance on a monthly basis. Pricing varies by geographic location:

  • India: Pro Plan ₹249/month, Ultra Plan ₹799/month
  • United States: Pro Plan $19.99/month, Ultra Plan $49.99/month
  • Other regions: USD pricing applies

5.2 Payment Processing

Payments are processed through Dodo Payments and other third-party payment processors. By providing payment information, you authorize us to charge the applicable fees to your payment method.

5.3 Refund Policy

NO REFUNDS: All subscription fees are non-refundable except as required by applicable law. You may cancel your subscription at any time, but cancellation will not result in a refund of fees already paid.

Exceptions: In exceptional cases (e.g., double billing, system error), refunds may be processed at our sole discretion.

Consumer Rights: Certain jurisdictions may provide statutory rights that override these terms. Where applicable, those rights shall prevail.

5.4 Auto-Renewal

Subscriptions automatically renew unless cancelled before 48 hours of the renewal date. You may cancel by removing auto payments through your bank/wallet/card or by contacting support.

5.5 Price Changes

We reserve the right to modify subscription prices with Immediate notice. Price changes will not affect your current billing cycle but will apply to subsequent renewals.

6. User Obligations and Prohibited Conduct

6.1 Acceptable Use

You agree to use our Service only for lawful purposes and in accordance with these Terms. You will not:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Use automated tools to scrape or harvest data
  • Create false or misleading profiles or resumes
  • Spam or send unsolicited communications
  • Interfere with other users' use of the Service

6.2 Content Standards

All User Content must be:

  • Accurate and truthful
  • Non-discriminatory and respectful
  • Free from illegal or harmful content
  • Compliant with applicable employment laws

6.3 Usage Limits

You agree to respect the usage limits associated with your subscription plan. Excessive use may result in service throttling or account suspension.

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Service, including all software, algorithms, designs, trademarks, and content, is owned by Job Crackle and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

7.2 User Content License

By submitting User Content, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and distribute your content solely for the purpose of providing our Service. You retain ownership of your original content.

7.3 AI-Generated Content

Content generated by our AI services based on your input is provided to you under a non-exclusive license. We retain the right to use anonymized and aggregated data to improve our AI models.

7.4 DMCA Compliance

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe your copyright has been infringed, please contact us with detailed information.

7.5 Electron Desktop Application Protection

Strict Prohibition on Reverse Engineering and Source Code Extraction:

Our Electron desktop application is proprietary software protected by copyright and intellectual property laws. The following activities are STRICTLY PROHIBITED and may result in legal action:

  • Reverse Engineering: Attempting to reverse engineer, decompile, disassemble, or derive source code from our Electron application
  • Source Code Extraction: Using any tools or methods to extract, view, or access the underlying source code, algorithms, or proprietary logic
  • Software Reproduction: Creating derivative works, clones, or competing software based on our application's functionality, design, or code
  • Binary Analysis: Analyzing application binaries, JavaScript bundles, or any packaged code for competitive or unauthorized purposes
  • API Extraction: Attempting to extract or replicate our internal APIs, endpoints, or communication protocols
  • Unauthorized Distribution: Redistributing, modifying, or creating patches for our desktop application

Legal Consequences: Violation of these terms may result in immediate account termination, legal action under applicable copyright and intellectual property laws, and claims for damages. We actively monitor and protect our intellectual property rights.

8. Data Protection and Privacy

8.1 Privacy Policy

Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8.2 Data Security

We implement industry-standard security measures to protect your data, including encryption, secure transmission protocols, and access controls.

8.3 Data Retention

We retain your data as necessary to provide our Service and comply with legal obligations. You may request data deletion subject to our retention policies and legal requirements.

9. Disclaimers and Limitations of Liability

9.1 Service Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Job Data Accuracy

We aggregate job data from third-party sources and cannot guarantee its accuracy, completeness, or timeliness. You should verify all job information independently before applying.

9.3 AI Service Limitations

Our AI services are tools to assist with resume optimization and job matching. We do not guarantee employment outcomes or the accuracy of AI-generated content.

9.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

10. Indemnification

You agree to indemnify, defend, and hold harmless Job Crackle and its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your User Content or any content you submit
  • Your violation of any third-party rights
  • Any misrepresentation made by you
  • Your breach of any applicable laws or regulations

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting support or using account settings. Termination does not entitle you to a refund of prepaid fees.

11.2 Termination by Us

We may suspend or terminate your account immediately for violation of these Terms, illegal activity, or other conduct that may harm our Service or other users.

11.3 Account Banning and Violations

Immediate Account Termination and No Refund Policy:

We reserve the right to immediately ban and terminate accounts for the following violations, with NO REFUND of any paid subscription fees:

  • Account Sharing: Sharing login credentials or allowing unauthorized access to your account
  • Data Scraping: Using automated tools, bots, or scripts to extract data from our platform
  • Service Abuse: Excessive API calls, attempting to bypass usage limits, or overloading our systems
  • Fraudulent Activity: Creating fake accounts, providing false information, or payment fraud
  • Terms Violation: Any material breach of these Terms of Service
  • Illegal Activity: Using our service for any unlawful purposes

Warning: Banned accounts will lose all access immediately and permanently. All subscription fees paid are forfeited with no possibility of refund or credit.

11.4 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account and data, though some information may be retained as required by law or our Privacy Policy.

12. Dispute Resolution

12.1 Governing Law

Since Job Crackle is an Indian company, these Terms are primarily governed by the laws of India.All users, regardless of their location, agree that Indian law will apply to these Terms and any disputes arising from your use of our Service.

12.2 Jurisdiction

All disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka, India.By using our Service, you agree to submit to the jurisdiction of Indian courts for any legal matters.

12.3 Dispute Resolution Process

Step 1: Contact our support team at hi@jobcrackle.com to try to resolve the issue informally

Step 2: If informal resolution fails, you may file a complaint with our Grievance Officer

Step 3: Any dispute not resolved informally shall be referred to binding arbitration in Bangalore, India, under the Arbitration and Conciliation Act, 1996. The language of arbitration shall be English.

Step 4: If arbitration is not applicable, legal proceedings will be conducted in Bangalore, Karnataka courts

12.4 Consumer Rights

Nothing in these Terms limits your rights as a consumer under applicable Indian consumer protection laws. You may also approach consumer forums and other statutory authorities as per Indian law.

13. Compliance with Laws

13.1 Primary Compliance - Indian Laws

As an Indian company, we primarily comply with Indian laws and regulations:

  • Information Technology Act, 2000 - For digital services and data protection
  • Digital Personal Data Protection Act, 2023 - For handling your personal information
  • Consumer Protection Act, 2019 - For protecting your consumer rights
  • Indian Contract Act, 1872 - For our contractual relationship with you
  • Foreign Exchange Management Act (FEMA) - For international transactions

13.2 International User Considerations

While we are an Indian company governed by Indian law, we also respect the privacy rights of international users and implement reasonable measures to comply with applicable international privacy standards where feasible.

13.3 Data Protection and Privacy Compliance

We comply with the provisions of the Digital Personal Data Protection Act, 2023. We also implement reasonable safeguards aligned with GDPR principles for international users. By using the Service, you consent to the transfer of your personal data to India and other jurisdictions where our processors operate.

13.4 Regulatory Authorities

We are subject to oversight by Indian regulatory authorities including the Data Protection Board of India, Ministry of Electronics and Information Technology (MeitY), and other relevant Indian government bodies.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

15. Disclaimer for Job Seekers

Important Notice for Job Seekers:

Job Crackle is a career support and AI-enabled resume optimization platform. We are not a recruitment agency and do not guarantee job placement, interview calls, or hiring outcomes. Job application and hiring decisions are at the sole discretion of employers. We provide tools and services to help improve your job search process, but employment outcomes depend on various factors beyond our control.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Job Crackle regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

16.4 Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.

16.5 Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, strikes, embargoes, war, cyberattacks, government actions, internet failures, natural disasters, or terrorism.
